Who these terms are with

The Second Build is sold and operated by Nuralyn, LLC. By buying or using it, you agree to what follows. If you do not agree, do not use it, and if you have already paid, ask for a refund.

What you are buying

A personal, non-exclusive, non-transferable license to access and use The Second Build for your own purposes, including the purposes of a business you own or work for. The price is $149, paid once. There is no subscription and you will not be billed again.

How you get access

After your payment clears we email the address you used at checkout a link for collecting your license key. The key is not in the email. The link opens a page that shows the key once, and only once, because we store a fingerprint of it rather than the key itself and genuinely cannot show it to you a second time. Save it when it is shown.

If you lose the key, you can have it replaced from the same email address. Replacing it issues a new key and stops the old one working. If the email never arrives, write to hello@thesecondbuild.dev and we will sort it out.

The updates window

Your purchase includes content published or revised during the 12 months following the date of purchase. When that window closes, everything you already have keeps working permanently. Nothing is removed, nothing stops loading, and there is no renewal to decline. Content published after your window closes is simply not included.

We do not promise any particular quantity of new material during the window. What we promise is that whatever is published in it is yours.

What you may not do

• Share, resell, sublicense, publish or redistribute the paid content, in whole or in part.
• Share your license key, or use one key across an organization. One license is for one person. That one person may use it on every device they use, which is the point of a key rather than an account, but it is not a seat to hand around.
• Circumvent, disable or attempt to defeat the license checks that protect the paid content.
• Scrape, bulk download or mirror the paid content, or use it to train a machine learning model.

Ordinary fair use is unaffected. Quoting a short passage with attribution, in a review, a class or an argument with your cofounder, is not what the restrictions above are aimed at. Republishing the material, or reproducing enough of it to substitute for buying it, is.

Who owns what

Nuralyn, LLC owns the content, the software and the name. You own anything you write or calculate using it, including the figures you enter and the results you produce. We claim nothing over your data because we never receive it.

This is education, not advice

The Second Build is educational content. It is not legal, tax, accounting or investment advice, it does not create a professional relationship of any kind, and it cannot account for your circumstances. Laws and common practice differ by state and change over time. Talk to licensed professionals before acting on anything you read here. Decisions you make are yours.

No warranty

The product is provided as it is. We work hard on accuracy, cite primary sources, and test the calculations, but we do not warrant that the content is error free, complete or current, nor that the service will be uninterrupted.

Limit of liability

To the fullest extent the law allows, the total liability of Nuralyn, LLC arising out of these terms or your use of the product is limited to the amount you paid for it. We are not liable for indirect, incidental, consequential or punitive damages, or for lost profits, lost data or business decisions taken in reliance on the content.

Payment and refunds

Payments are processed by Stripe, Inc.. Applicable sales tax is calculated and added at checkout. Refunds are available within 14 days of purchase under the terms set out on the refund policy page, which forms part of this agreement.

Ending the license

You can stop using the product at any time. We may end a license if it is used to redistribute the paid content or to defeat the license checks, in which case no refund is due. We are not going to end your license for any other reason.

Changes to these terms

If these terms change in substance, the effective date above changes with them. Changes are not retroactive: the terms in force when you bought govern that purchase.

Governing law

These terms are governed by the laws of the State of Washington, without regard to its conflict of laws rules. The state and federal courts located in Washington have exclusive jurisdiction over any dispute arising from them.
